Per data released by Israel, a minimum of 98 Palestinians have perished while in custody since October 2023. A human rights group based in Israel has stated that the actual figure is probably substantially larger, because of many of disappeared people originating in Gaza.

Report Findings

An updated study tracked fatalities resulting from physical violence, lack of healthcare, and starvation. Analysts utilized official data requests, medical examiner documents, and discussions with lawyers, advocates, next of kin, and witnesses.

Even with the aggregate figure of fatalities documented being substantially larger than previous assessments, it almost certainly fails to capture the entire scope of Palestinian casualties, per the head of the prisoner monitoring division.

“Even though we are providing evidence for a larger total of casualties than earlier indicated, this is not the entire story,” he said. “We are certain that there are even now individuals who lost their lives in confinement that we have not identified.”

Civilian Deaths

Restricted government records indicates that the vast majority of Palestinian prisoners from Gaza who lost their lives in detention were ordinary citizens, per a parallel investigation.

During May of this year, a military intelligence database monitoring all combatants in Gaza, a list of more than 47,000 named individuals, listed merely 21 casualties in confinement. By that point, 65 Palestinians from Gaza had perished in detention.

Custodial Environment

Assault, abuse, and further cruelty of detainees from Palestine has become routine across Israel’s detention facilities over two years of conflict. High-ranking authorities have openly admitted minimal sustenance and an underground jail confining Palestinians who are denied sunlight.

Existing and previous detainees and informants from the armed services have collectively claimed systemic violations of international law.

Organized Maltreatment

The organized mistreatment was accompanied by a troubling surge in deaths documented across at least 12 civilian and military facilities in Israel. Over ten years before the hostilities, there were on average two or three deaths a year.

“This is not merely an isolated incident here and there. It is systemic and it will continue,” an official said, partly since there is a climate of near total impunity for killing and mistreating Palestinian individuals.

Just one case of attacking inmates has proceeded to court, with the military personnel sentenced to 210 days. An attempt to try other suspects over a severe beating involving sexual violence resulted in political demonstrations and the arrest of Israel’s chief legal officer, with the accused individuals now requesting that charges against them be withdrawn.

Absence of Consequences

“Despite this mass number of deaths, throughout the conflict no one has been arrested,” the official stated. “There have been no prosecutions over any killing.

“During the time these practices continue to be enforced, every Palestinian in custody is in danger, even the healthy ones, also the juveniles who have no underlying conditions.”

Prominent Examples

Some deaths in confinement have been widely reported, for instance a senior healthcare leader who died in prison after four months in detention.

An inmate detained alongside the victim reported that he was led to the courtyard by correctional officers immediately preceding his passing, clearly wounded and naked from the hips downward. His corpse remains unreleased to Gaza.

Additional detainees who died in confinement by Israeli authorities remain anonymous. Detention administrators and defense forces supplied researchers with the number of deaths in custody, and limited additional information including the site where they died, but not the detainees’ identities.

Identification Challenges

For 21 instances, mostly people from Gaza, investigators were not able to match the few details given by government bodies to a casualty recorded by human rights groups, by means of statements from released detainees or accounts in the news outlets.

The detainees’ families may not know about their relatives’ casualties either, as Israel has impeded efforts to locate Palestinians it is detaining.
